Release and Transport Registration for Environmental Protection
Regulation. The Pollutant
Emission and Transport Registration Regulation (“Regulation”) was
published by the Ministry of Environment, Urbanization and Climate
Change (“Ministry”) in the Official Gazette dated 4 December
2021. In this context, the regulation regulates the procedures and
principles for the creation of a registration of the release and
transport of pollutants in order to protect the environment and
reduce environmental pollution originating from diffuse sources and
industry.
PRTR Record and Duration. The Pollutant
Release and Transport Register (“PRTR”) is a publicly
accessible and electronic database created to facilitate public
participation in decision-making processes on environmental issues
and to contribute to the prevention and reduction of environmental
pollution. The content of the PRTR, which is made available to the public,
is regulated within the scope of the Regulation. The operator of each
facility that carries out one or more of the activities listed in
Annex-1 of the Regulation should register to the PRTR system of the
Ministry (i) within 6 (six) months
after the Regulation's entry into force for the facilities operating
on the date of entry into force of the Regulation (ii) within 3
(three) months from the date of obtaining the permission for the
facilities established after the effective date of the regulation, or
(iii) within 3 (three) months from the date of the change, for the
facilities that have the obligation to report PRTR as a result of the
capacity or activity change that will take place after the effective
date of the Regulation.
Reporting Obligation. The operator,
which has one or more of the activities listed in Annex-1 of the
Regulation, has to submit an annual report to the Ministry in line
with the procedures and principles in the Regulation. It should also
be mentioned that the operator is under the obligation to keep
records of the reported information for five years from the end of
the reporting year. As a result of confidentiality request based on
valid reason and submitted to the Ministry within the scope of
reporting, it can be ensured that any information is excluded from
the public PRTR system. The deadline for reporting information for
each reporting year by the operator is 31 March of the following
year. According to the transitional provision, the first reporting
year after the effective date of the Regulation is the first full
calendar year.
If there is a
violation within the scope of the duties, powers and responsibilities
of the operators within the scope of the relevant Regulation,
administrative sanctions will be applied in accordance with the fifth
section of the Environmental Law No. 2872, titled penal provisions.
